arizona and the obama administration. this time, over the state requirement that those who seek to register to vote provide proof of u.s. citizenship. arizona registration form requires more proof than the simpler federal form. on which applicants check a box, ind kateing u.s. citizen think, sign attesting to that fact and drop it in the mail. arizona argues that it doesn't conflict with the federal form but serves as an additional barrier against voting by non-u.s. citizens. >> if somebody is willing to fraudulently vote that person would be willing to sign fals falsely. so the signature doesn't mean anything. we need evidence that the person is a citizen. >> justice scalia sounded skeptical of the streamlined federal form. "check off, i am a citizen, right? so it's under oath. big deal. if you are willing to violate the voting laws i suppose you're willing to violate the perjury laws." despite issue the arizona officials say they are facing justices like ruth bader ginsberg said there are statutes saying they must accept and use the federal form period. that is the end of it.

, the obama administration is tooting the fact that he oversaw lending elements at the justice department, but not talking about the methods used in the cases. he used desperate impact, a way, basically, of using statistics to prove discrimination. if more blacks denied home loans than whites, that's automatically racial discrimination. more black kids sus pended rather than white kids, that's automatic racial discrimination. the facts don't matter, just the outcome. dagen: how could he apply that thinking in his job as labor secretary? what would be the impact there? >> well, the government can shame businesses. it can shame districts in terms of school district. government wields a lot of authority, and a lot of moral persuasion, and even the fact that you can bring attention to certain situations or the threat of government action is enough sometimes, and the problem here is that if doesn't always have the intended effect. i mean, if you force banks to loan to people who can't afford to pay them back, these people will be saddled with foreclosed homes and poor credit ratings at the end

't expecting much from president obama's visit. the obama administration made it clear that it's a listening tour and he'll speak to israeli and palestinian officials to get the lay of the land of where they see the future of the region but that being said, secretary of state john kerry is also here at the moment in jerusalem. he will be making these meetings and these rounds as well. he'll stay in the region after president obama leaves. he'll come back to jerusalem, speak to israeli officials about possibly starting peace talks -- starting peace talks again to find resolution when it comes to israeli/palestinian issue. it will be interesting to see what president obama says tomorrow when he speaks in front of hundreds of israeli students. he's made some strong words in the past condemning settlement construction in the occupied territories of the palestinians in the west bank. interesting to see what he has to say to these israeli students tomorrow. kelly? >> great stuff. thanks very much for that. straight ahead on the program, the internet isn't a vending machine. that's according to our

tests were very rigorous. in fact be assumed obama administration's recovery program would fail, that it would not only fail to make things far worse, which is curious given the entity that created those stress test is a treasury department given the task of promoting and carrying out the recovery program. it's not the writer of the test i questioned, but rather their necessity. peter seems to accept the assumption they were needed in or to restore investor confidence in banks. peter is correct the test or something of a gamble to secretary geithner. but perhaps an unnecessary one. investors were already beginning to return to banks long before the results of the stress tests were reported. i do agree with the assessment of the outcome peter makes. it exposed alarmism of expert for what it was. another important conclusion that peter elaborates as they show how far off base mark to market accounting is for evaluating a set that banks tend to hold. banks hold their assets for the cash flow, not for firesale value in the cash flow of assets performed far better than the mark to ma
